Welcome to Pictoria! Please read these Terms of Service ("Terms") carefully before using our services.
1. Acceptance of Terms
By creating an account, logging in, or otherwise using the services provided by Pictoria, you agree that you have read, understood, and consent to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our services.
2. Additional Policies
In addition to these Terms, your use of Pictoria is also subject to our:
- Community Guidelines, which outline the rules and expectations for user behavior on our platform.
- Privacy Policy, which describes how we collect, use, and protect your personal information.
By using Pictoria, you agree to comply with the Community Guidelines and you agree to accept the Privacy Policy.
3. Account Requirements
- Age Requirement: You must be at least 13 years old to create an account on Pictoria. If you are under 18, you must have permission from a parent or legal guardian who agrees to these Terms on your behalf.
- Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately of any unauthorized use of your account.
4. User Conduct
When using Pictoria, you must comply with all applicable laws and our Community Guidelines. Prohibited activities include, but are not limited to:
- Engaging in illegal activities
- Posting or transmitting content that infringes on the intellectual property rights of others
- Harassing, threatening, or causing distress to other users
Pictoria reserves the right to remove or disable access to any content that violates these Terms or our Community Guidelines.
5. User-Generated Content
Users retain ownership of the content they create and upload to Pictoria. By uploading content, you represent and warrant that:
- You own or have the necessary licenses, rights, consents, and permissions to publish and share the content on Pictoria.
- Your content does not infringe on any third-party intellectual property rights, including copyrights, trademarks, or patents.
You agree to bear full responsibility for any claims, damages, or losses arising from your user-generated content, including any infringement of third-party intellectual property rights. Pictoria reserves the right to remove any content that is found to be infringing on the intellectual property rights of others.
By uploading content, you grant Pictoria a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the service and Pictoria's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the service (and derivative works thereof) in any media formats and through any media channels.
6. Intellectual Property
All content provided on Pictoria, excluding user-generated content, is the property of Pictoria or its content suppliers and is protected by Singapore and international copyright, trademark, and patent laws. User-generated content remains the intellectual property of the respective creators. If you believe that your intellectual property rights have been infringed upon, please contact us.
7. Prohibited Activities
You may not engage in any of the following activities:
- Reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code of the Pictoria platform
- Using any automated means, such as robots, spiders, or scrapers, to access, monitor, or copy our web pages or their content without prior written permission from Pictoria
- Using, reproducing, or distributing Pictoria's source code or any derivative works based on it without express written consent from Pictoria
8. Termination
We reserve the right to terminate or suspend your account and bar access to the service immediately, without prior notice or liability, at our sole discretion, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the service will immediately cease, and Pictoria may remove or disable access to any content you have posted on the platform. You may also terminate your account at any time by contacting us.
9. Limitation of Liability
In no event shall Pictoria, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
10. Indemnification
You agree to defend, indemnify, and hold harmless Pictoria, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the service, including, but not limited to, your user-generated content, any use of the service's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the service.
11. Disclaimers
The service is provided on an "as-is" and "as available" basis. Pictoria makes no representations or warranties of any kind, express or implied, as to the operation of the service or the information, content, materials, or products included on the service. You expressly agree that your use of the service is at your sole risk. Pictoria disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Dispute Resolution
Any dispute arising out of or relating to these Terms or the service shall be resolved through binding arbitration in accordance with the Singapore International Arbitration Centre (SIAC) Rules. The arbitration shall be conducted in Singapore, and the language of the arbitration shall be English. The arbitrator's decision shall be final and binding on all parties.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section.
14. Entire Agreement
These Terms, together with the Community Guidelines and Privacy Policy, constitute the entire agreement between you and Pictoria and govern your use of the service, superseding any prior agreements or understandings between you and Pictoria.
15. Changes to Terms
We may modify or replace these Terms at any time, at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the service.
16. Governing Law
These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.
